CONSTRUCTION SAFETY ORDERS – WASHING FACILITIES, FOOD HANDLING, AND TEMPORARY SLEEPING QUARTERS, WASHING FACILITIES PROVIDED IN ASSOCIATION WITH NONWATER CARRIAGE TOILET FACILITY Cal. Code Regs, tit. 8, § 1527(a)(1)(F) (2019) – The Division did not establish that Employer violated the safety order by failing to provide a washing station with a portable toilet. CONSTRUCTION SAFETY ORDERS – FALL PROTECTION, PERSONAL FALL ARREST SYSTEMS, PERSONAL FALL RESTRAINT SYSTEMS AND POSITIONING DEVICES Cal. Code Regs, tit. 8, § 1670(a) (2019) –  Employer violated the safety order by failing to ensure an employee, whose work exposed him to a fall of more than 7½ feet from the unprotected side and edges, leading edges and through openings, wore approved fall protection equipment. However, Employer established the independent employee action defense. GENERAL PHYSICAL CONDITIONS AND STRUCTURES ORDERS – INJURY AND ILLNESS PREVENTION PROGRAM (IIPP) Cal. Code Regs, tit. 8, § 3203(a) (2019) –  The Division did not establish that Employer failed to identify or correct unsafe or unhealthy working conditions, work practices or procedures pursuant to its IIPP.
